IMS LAW GUARANTEE PROGRAM

TERMS AND CONDITIONS

1. PURPOSE AND SCOPE

• The IMS Law Guarantee Program (“Guarantee Program”) provides an eligible student who does not receive a final admission (“Final Admit”) to any of the
  Law Schools specified in List A or List B, as applicable, for the relevant admission cycle, with both of the following benefits:
  1. a full refund of the programme fee actually paid, including applicable GST; and
  2. free repeat coaching in a Special Repeaters batch for the immediately succeeding admission cycle, subject to payment of the entire programme fee and fulfilment of all eligibility criteria and other terms and conditions set forth herein.
• Both benefits shall be available together and may be claimed only once in respect of the relevant admission cycle. The benefits are non-transferable, non-refundable and cannot be combined with any other IMS offer, discount or waiver.
• The Guarantee Program shall be applicable only to students enrolled in an eligible IMS Classroom Programme or Live Online Programme, as specified in the Guarantee Certificate issued to the student.

2. ELIGIBILITY CRITERIA

A student shall be eligible to avail of the Guarantee Program only if all the following conditions are fulfilled:

• Academic Eligibility
  The student must have secured:
  1. a minimum of 75% aggregate marks in Class X; and
  2. a minimum of 80% marks in English in Class X.
• Attendance Requirement

  The student must maintain a minimum of 80% attendance at classroom/live lectures (as specified herein below in the List of Lectures), calculated from the date of joining the programme.

  The attendance requirement shall apply irrespective of any personal, academic, or other constraints, including health conditions. A student who is unable to attend a scheduled lecture may, with prior intimation to the concerned IMS Centre, request a backup lecture, subject to availability. It shall be the student’s responsibility
  to coordinate with the concerned mentor/IMS Centre and attend the available backup lecture. Any conflict with school/college timings shall not, by itself, constitute grounds for a refund or relaxation of the eligibility criteria.

National-Level Mock Tests
The student must attempt at least 80% of all National-Level Mock Tests, including SimCLAT and SimAILETS, conducted by IMS in the prescribed proctored format during the applicable programme period.

IMS shall share attendance and test-taking reports with the student and the parents/legal guardian once every month. Any discrepancy in such records must be reported to IMS / the concerned IMS Centre within 10 days of receipt of the report. Subject to correction of any verified error, IMS’s records shall form the basis for determining eligibility under the Guarantee Program.

• Applications to Law Schools specified in List A
  The student must:
  1. apply, within the prescribed timelines, to all Law Schools/National Law Universities (NLUs) specified in List A;
  2. complete all applicable CLAT-UG counselling formalities and requirements;
  3. participate in all common counselling rounds, wherever applicable;
  4. separately apply to all NLUs specified in List A for counselling against vacant seats, wherever such applications are invited;
  5. pay all applicable registration fees, counselling fees, deposits, or other amounts within the prescribed timelines, wherever required;

AND

• Applications to Other Law Colleges specified in List B
  The student must:
  1. apply, within the prescribed timelines, to at least 5 out of the 12 Law Colleges specified in List B;
  2. attempt at least 80% of the applicable SimTests conducted for the entrance examinations of the selected 5 Law Colleges; and
  3. appear for a Personal Interview or any other admission/selection round for which the student is shortlisted or required to participate by the concerned institution.

 

• Payment of Programme Fee and Continuity
  The student must pay the entire programme fee, including applicable taxes, within the prescribed timelines and remain enrolled in the programme for its prescribed duration.

 

• Timeline
  1. Students enrolled in the CLAT Classroom and Live Programs are eligible for a refund, provided the request is made by the student within the first 5 sessions scheduled from the date of enrollment and before the start of the 6th scheduled session.
  2. No refund will be processed if the refund request is submitted after the completion of the applicable scheduled 5-session period or after the commencement of the 6th scheduled session, as applicable.

3. REFUND AND FREE REPEAT COACHING CLAIM PROCEDURE

• An eligible student must submit a written claim for the full fee refund and free repeat coaching to the concerned IMS Centre within the prescribed claim period.
• The claim must relate to the admission cycle specified in the Guarantee Certificate and must be submitted between 1 August and 31 August of the relevant admission cycle, after publication of the final admission lists against vacant seats by the applicable Law Schools specified in List A.
• The written claim must be accompanied by:
  1. all documents specified in the List of documents below;
  2. a copy of the Guarantee Certificate;
  3. the student’s IMS PIN and programme fee payment receipt; and
  4. the original payment details or the original payer’s bank account details required for processing the full refund.
• A claim not submitted with the mandatory documents within the prescribed claim period shall be invalid and shall not be processed.

4. VERIFICATION AND PROCESSING OF CLAIM

• Upon receipt of a claim, IMS shall verify the student’s compliance with these Terms and Conditions and the completeness and authenticity of the documents and information submitted. IMS may seek any additional documents or information reasonably required for verification, and the claim shall be processed only upon completion of such verification.
• Upon approval of the claim:
  1. The full refund shall be processed within 15 working days from the date of completion of verification, through the original mode of payment or to the original payer’s bank account; and.
  2. IMS shall communicate the details and enrolment process for the applicable Special Repeaters batch.

5. EXCLUSIONS AND LIMITATIONS

• The Guarantee Program does not guarantee admission, rank, score or selection to any Law School. IMS provides preparatory support only, and all admission decisions and processes remain under the control of the respective institutions.
• A student who receives a Final Admit from any Law School specified in List A or List B but voluntarily declines or does not accept the admission shall not be eligible for any benefit under the Guarantee Program.
• IMS’s liability under the Guarantee Program shall be limited to the benefits specified under Clause 1.1, subject to applicable law.

6. DISPUTE RESOLUTION AND FINALITY OF DECISION

• The decision of IMS regarding the interpretation and application of these Terms and Conditions, including the eligibility of a student and the admissibility of any claim, shall be final and binding upon the student and/or the student’s parent/legal guardian.
• These Terms and Conditions shall be governed by the laws of India. Subject to applicable law, all disputes arising out of or in connection with the Guarantee Program shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra.

7. ACKNOWLEDGEMENT

• By enrolling in the IMS Law Guarantee Program and accepting the Guarantee Certificate, the student and the parent/legal guardian acknowledge that they have read, understood and accepted these Terms and Conditions and that the benefits shall be available only upon complete compliance therewith. They further confirm that all documents and information submitted in connection with the Guarantee Program shall be true, complete and accurate.
